Agreement to Terms

By downloading, installing, purchasing, or using any product, application, or service from Healing With Excellence Organization ("HWE Org"), including HealingTracker and Real Level Up (collectively, "Products"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use HWE Org's Products or Services.

We reserve the right to update these Terms at any time. Continued use of HWE Org's Products or Services after changes constitutes acceptance of the updated Terms.

About Healing With Excellence Organization

Healing With Excellence Organization ("HWE Org") is a non-profit entity dedicated to empowering individuals on their healing and personal growth journeys. HWE Org provides digital tools, educational content, and community support to foster holistic well-being and excellence in life.

HWE Org offers a range of products and services, including but not limited to the HealingTracker and Real Level Up mobile applications. These products are made available for purchase or download and are governed by these Terms.

About HealingTracker

HealingTracker is a flagship product of HWE Org, designed to empower users on their wellness and personal growth journeys. HealingTracker is a comprehensive, user-friendly mobile application that enables individuals to monitor, reflect on, and improve their daily habits and well-being.

• Track daily habits, wellness, and challenge checklist items with customizable options
• Log water intake, nutrition, exercise, learning, and breathing metrics
• Capture and securely store daily progress photos
• Write daily journal reflections and set personal goals
• View challenge timelines, progress history, and receive achievement badges
• Receive optional, user-controlled motivational push notification reminders
• Access curated educational and healing resources from HWE Org
• Benefit from robust data privacy, security, and user control features
• Enjoy a modern, accessible interface designed for all users

Accessibility & Eligibility

• HealingTracker is designed to be accessible to users of all abilities, with support for screen readers and adaptive technologies.
• Users must be at least 13 years old or the minimum age required by law in their jurisdiction to use HealingTracker. Parental consent is required for minors where applicable.

Data Retention & Deletion

• User data is retained only as long as necessary to provide app features or as required by law.
• Users may request deletion of their account and all associated data at any time via in-app settings or by contacting support.

Third-Party Integrations

• HealingTracker may offer optional integrations with third-party services (such as calendar or reminder apps) to enhance user experience. All integrations are opt-in and require explicit user consent.
• HealingTracker does not share user data with third parties except as necessary to provide requested features or as required by law.

Feedback & Improvements

• Users are encouraged to provide feedback and suggestions to help improve HealingTracker. Feedback can be submitted via the app or by contacting support.
• HWE Org may use anonymized, aggregated data to improve app features and user experience.

Updates & Changes

• HealingTracker is regularly updated to enhance features, security, and compliance. Users will be notified of significant changes via in-app notifications or update notes.
• Continued use of HealingTracker after updates constitutes acceptance of the new features or terms.

App Store Compliance & User Trust

• HealingTracker complies with all Apple App Store Review Guidelines, including user privacy, data security, and transparent data practices.
• All user data is stored securely, never sold to third parties, and is only used to provide app features.
• Users can export or delete their data at any time via in-app settings or by contacting support.
• Parental controls and age-appropriate content are implemented to protect minors.
• Clear, accessible terms and privacy policies are provided within the app and on our website.
• HealingTracker does not require or access sensitive health data from Apple HealthKit or similar services unless explicitly authorized by the user, and only for the stated purpose.
• All in-app purchases, subscriptions, and features are transparently disclosed and comply with Apple’s requirements.

Responsible Use

HealingTracker encourages responsible self-care and personal growth. The app is not a substitute for professional healthcare, therapy, or emergency services. If you are experiencing a medical emergency or mental health crisis, contact a qualified professional or emergency services immediately.

Accounts

• You must provide accurate and complete information when creating an account for any HWE Org product or service.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account with others or use HWE Org products to impersonate another person.
• You must notify us immediately at support@healingwithexcellence.org if you suspect unauthorized access to your account.
• We reserve the right to terminate accounts that violate these Terms.

User Content

You retain ownership of all content you create in HWE Org products, including photos, journal notes, and challenge data ("User Content").

By uploading User Content, you grant HWE Org a limited, non-exclusive license to store and display that content solely for the purpose of providing product features to you.

You are solely responsible for the content you upload. You agree not to upload content that is:

• Illegal, harmful, or offensive
• Violating the rights of any third party
• Containing malware or harmful code

Acceptable Use

You agree to use HWE Org's products and services only for their intended purpose. You agree not to:

• Attempt to reverse-engineer, decompile, or tamper with any HWE Org product or service
• Circumvent or interfere with product or service security features
• Use HWE Org products or services for any unlawful purpose or in violation of any applicable law
• Access or attempt to access another user's account or data
• Transmit spam, viruses, or any other harmful content through HWE Org products or services
• Use automated bots or scripts to interact with HWE Org products or services

Intellectual Property

All HWE Org products and services, including their design, code, graphics, branding, and content (excluding User Content), are owned by Healing With Excellence Organization and its affiliates, and are protected by copyright and intellectual property laws.

You may not copy, modify, distribute, or create derivative works from HWE Org's content without our explicit written permission.

Privacy & Data Protection

We respect your privacy and are committed to protecting your personal data. We collect and process only the data necessary to provide and improve HWE Org's products and services, in accordance with our Privacy Policy.

• We do not sell your personal data to third parties.
• Data is stored securely and only accessible to authorized personnel.
• We comply with applicable privacy laws and Apple App Store requirements.

Disclaimer of Warranties

All HWE Org products and services are provided "as is" and "as available" without warranties of any kind, express or implied. HWE Org makes no warranties that:

• Products or services will be uninterrupted, error-free, or secure
• Products or services are suitable for any particular fitness, health, or wellness purpose
• Any data stored via HWE Org products or services will never be lost or corrupted

Limitation of Liability

To the maximum extent permitted by applicable law, Healing With Excellence Organization and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use HWE Org products or services
• Loss of data or challenge progress
• Unauthorized access to your account or data
• Any errors, bugs, or interruptions in HWE Org products or services

Our total liability to you for any claim shall not exceed the amount you paid to use HWE Org products or services (if any) in the twelve months preceding the claim.

Termination

You may stop using HWE Org products or services and delete your account at any time by contacting us at support@healingwithexcellence.org.

We may suspend or terminate your access to HWE Org products or services at our discretion if you violate these Terms or for any other lawful reason, with or without prior notice.

Governing Law

These Terms shall be governed by and interpreted in accordance with applicable law. Any disputes arising from these Terms or your use of HWE Org products or services shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or a court of competent jurisdiction.

Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via an in-app notification, product update, or email. Continued use of HWE Org products or services after the effective date of any changes constitutes your acceptance of the new Terms.
